The Labour Court upheld the rejection of Wieslawa Jaskulska’s payment-of-wages complaint against William P Keeling & Sons Unlimited Co in a determination dated 10 February 2020. The complaint concerned wages she said were unpaid during a lay-off. Ms Jaskulska argued that work was available while she was ready to return after leave, and that she had been unfairly selected for lay-off. The company said staffing depended on weather and seasonal work, and that she was unavailable for the first two intakes while on leave. The Court found that her contract allowed for lay-off and that the Payment of Wages Act did not require wages to be paid during a lay-off period.
