Labour Court finds no jurisdiction over John Madden’s alleged penalisation claim

The Labour Court found it had no jurisdiction over John Madden’s complaint against FTP Recruitment Limited T/A Clarity Locums and set aside the Adjudication Officer’s decision. The determination was signed on 12 February 2020. Madden, a locum pharmacist, claimed the agency penalised him after he raised concerns about alleged employment-rights breaches, and that he was unable to acquire work through it. The Court found he was not elected or appointed as an employee representative under the Act and that the statutory conditions for referring the dispute had not been met; the alleged penalisation was not decided on its merits.
