The Labour Court upheld the rejection of Anna Domniak’s Payment of Wages complaint against William P Keeling & Sons Unlimited Co in a determination dated 10 February 2020. Domniak, a permanent horticultural farm worker, argued that wages were due during a seasonal lay-off because work was available and other employees were given work. The company said staffing depended on the weather and planned intake dates, and Domniak had been on leave during the first two intakes. The Court found that her contract provided for lay-off and that the Payment of Wages Act did not require wages to be paid during a lay-off period. Her complaint failed on its merits.
