The Labour Court reduced Marek Korzeniewski’s unfair dismissal compensation from €10,000 to €4,900 on Keelings Logistics Solutions Uc’s appeal. The determination was dated 3 February 2020. The employer no longer contested that the dismissal was unfair; the appeal concerned the amount of redress.
The Court said reinstatement or re-engagement was not practical and chose compensation. Korzeniewski had claimed €16,000 in losses, mainly for the pay difference between his former job and his current work as a kitchen porter. He had not looked for another general operative job and had chosen lower-paid kitchen work to develop skills in that area.
The employer argued it should not be liable for losses arising from that choice. The Court found Korzeniewski had suffered financial loss because of the dismissal and considered €4,900 just and equitable.
