The Labour Court overturned a decision that it had no jurisdiction to hear Cathal O’Toole’s complaint and ordered Pavementside Limited to pay him €4,586.78. The determination was dated 17 September 2018, and the award was to be paid within six weeks.
O’Toole said he had not been paid for all the hours he worked or for outstanding annual leave when his employment ended. He claimed €4,122.81 for unpaid hours and €463.97 for leave. Pavementside’s director said he had no day-to-day dealings with O’Toole and did not dispute the details of his claim.
The Court found the complaint well founded on the uncontested evidence. It also changed the employer’s name in the earlier decision to Pavementside Limited, then overturned the adjudication officer’s decision and allowed O’Toole’s appeal.
