Labour Court upholds time-bar ruling on pension complaint

The Labour Court upheld a ruling that Mr Patrick Joseph Moran’s pension complaint against Galway & Roscommon Education Board was out of time. The determination is dated 29 April 2024, and the merits were not decided. Moran accepted that he had filed late and asked the Court to set aside the statutory time limits. The Court said it could not extend its jurisdiction beyond the powers given to it by the Pensions Act 1990. It found the complaint statute barred, dismissed the appeal and upheld the Adjudication Officer’s decision.
