Labour Court declines Brian Dunne’s late appeal in minimum wage case

The Labour Court found Brian Dunne’s appeal in Christopher Clifford’s minimum wage case was outside the time limit and that it had no jurisdiction to hear it. The determination was dated 23 November 2020; the merits were not decided on appeal. Dunne said different issue dates for related decisions had caused confusion about the deadline. Clifford opposed an extension. The Court found Dunne had not shown that exceptional circumstances prevented a timely appeal. The Adjudication Officer’s finding that Clifford’s complaint was well founded, with compensation awarded, remained undisturbed.
