The Labour Court set aside a €2,159.89 award to Laura Hetherington and found her Payment of Wages Act complaint against Goldfish Telecoms Limited not well founded. The determination was signed on 23 November 2020.
Hetherington appealed, claiming €6,143 in commission on €61,430 of sales completed in the quarter to 30 September 2019. Goldfish Telecoms argued that her contract ended her commission entitlement when she resigned and that some sales were incomplete. The company said 10% of completed sales would amount to €1,439.96.
Both sides agreed the commission would not have been payable until 25 November 2019. The Court found that no wages were properly payable during the complaint period, which ended on 10 October 2019. It concluded that no unlawful deduction had been made and set aside the Adjudication Officer’s decision.
