The Labour Court upheld the Rights Commissioner’s decision that Sandra Gegeckiene was paid the statutory minimum wage. In its determination, signed on 24 February 2015, the Court rejected her appeal against John Thomas Bradbury T/A Bradburys. Gegeckiene argued that her contract required her to be available for work between 7am and 7pm, seven days a week, so all those hours should count when calculating her hourly pay. Bradburys said she was paid for her rostered hours. The Court found that weekly rosters set her working hours and that she did not have to remain available outside those hours. It found the complaint not well founded.
