The Labour Court found Mark Smith’s minimum-notice complaint well founded and directed Thornton Construction to pay him €4,410. The determination was dated 5 April 2023, setting aside the Adjudication Officer’s earlier decision that the claim was not well founded after Smith did not attend the first-instance hearing. Smith worked for Thornton Construction from 6 November 2006 until 30 July 2021 and earned €735 a week. In a linked appeal, the Court determined that his employment ended by reason of redundancy. With more than 14 years’ continuous service, Smith was entitled to six weeks’ statutory notice under the Minimum Notice and Terms of Employment Acts.
