WRC rejects Sean Roche’s redundancy claim

The Workplace Relations Commission rejected Sean Roche’s claim for a statutory redundancy payment, finding that he resigned from Molum Transport Limited before a proposed short-time arrangement began. Adjudication Officer Bríd Deering issued the decision dated 5 April 2023. Roche said his truck-driving work was affected when the company’s subcontract ended and sought redundancy. The company said it intended short-time work as a temporary measure while exploring other work, and that Roche resigned before any short-time working began. The adjudicator accepted that account and found Roche was not entitled to a redundancy lump sum.
