The Labour Court rejected Conor Williamson’s appeal under the Minimum Notice and Terms of Employment Act 1973, finding his claim was not well-founded. The determination was dated 21 December 2022.
Williamson worked as a licensed dog warden for David Stone T/A Ashton Dog Pound and Warden Services from July 2017 until 30 June 2021. Ashton provided dog warden services to Dublin City Council under contract, and Williamson worked on the council contract alone.
After a tender process failed to appoint another provider, the council brought the service in-house. It took five dogs and related records from Ashton but did not take on any of its staff, including dog wardens.
The appeal concerned whether Williamson’s employment transferred to the council. The Court had determined in related appeals that no transfer of undertakings took place between Ashton and the council. It found this claim not well-founded, the appeal failed and the Adjudication Officer’s decision was upheld.
