The Labour Court upheld the Adjudication Officer’s decision that Olwale Noah Olade O'Noah’s minimum notice complaint was not well founded. The determination was dated 13 December 2022. Olade O'Noah appealed the decision concerning his dismissal from Musgrave Operating Partner Limited Supervalu for gross misconduct on 3 July 2020, when his hourly rate was €14.67 and he worked 35 hours per week. He said he was dismissed unfairly and without notice. The company’s policy provided that no notice was payable for dismissal for gross misconduct. Relying on its finding in a linked case that the dismissal for gross misconduct was fair, the Court concluded that the complaint must fail. The appeal failed and the Adjudication Officer’s decision was upheld.
