The Labour Court allowed Noonan Services Group Ltd’s appeal and set aside the Adjudication Officer’s decision on Dureza Sumayao’s Payment of Wages complaint. The determination was dated 13 December 2022. Sumayao said she was underpaid because her €10.98 hourly rate did not rise when Employment Regulation Orders were enacted. The company argued her contract did not provide for recurring increases. The Court found no term of her employment entitled her to those increases and that the wages properly payable had been paid. Sumayao did not attend the appeal hearing, but the Court considered both sides’ submissions and decided the merits. It found no breach of the Act and allowed the company’s appeal.
