The Labour Court upheld an Adjudication Officer’s recommendation in a worker’s appeal over a written warning from Clare County Council. The decision was dated 17 January 2024. The worker, a Senior Staff Officer, argued the council should have delayed the disciplinary meeting while responding to his information requests. The council said the allegations were clear and he should have started an appeal within the specified period. The Court found the worker could not have been in doubt about the allegations and that his decision not to attend the disciplinary meeting was unjustified and unacceptable. It also found he should have initiated an appeal within the stated period, then sought extra time to prepare if needed.
