The Labour Court recommended that a former temporary porter at the Mid-Western Health Board be placed on a panel for temporary porter work. The recommendation was signed on 29 April 2002.
The worker said he was unfairly dismissed after not being offered a third contract. The Board said temporary staff had no right to continued employment and that the worker had not been given the impression he would receive another contract.
The Court said the nature of the worker's transgressions 15 years earlier could reasonably have been disregarded for temporary hospital employment. It also noted that the hospital had put a screening process in place to prevent a similar situation in future.
