The Labour Court recommended that Nacanco Limited not concede the Services Industrial Professional Technical Union’s claim to promote a worker to a Quality Control Inspector vacancy. The recommendation was signed on 16 December 1992. The union argued that the worker’s 10 years’ service, experience and capabilities should have outweighed the successful applicant’s nine months’ service. Nacanco said it had acted fairly under its agreement, which gave the company discretion over appointments. The Court found no discrimination in the worker’s failure to obtain the posts applied for. It said the agreement’s promotion procedures made it unfeasible to recommend promotion to the next vacancy, but suggested the company consider helping long-serving employees pursue promotion.
