Labour Court rejects late claim by Revenue worker

By Niamh Kearney

Labour Court ·

In 1994, the Labour Court rejected a Revenue worker’s claim after finding she had not shown reasonable cause for lodging it outside the statutory time limit. The decision was signed on 13 October 1994; the merits were not decided.

The case concerned a claim under section 19(5) of the Employment Equality Act, 1977, against the Revenue Commissioners. IMPACT represented the claimant. The Court found that she had access to a seniority list and knew how Revenue calculated her service for seniority because of job-sharing. It also found she knew about promotions in her local office and was probably aware of promotions in Dublin, many of them to people junior to her.
