Labour Court dismisses worker’s constructive dismissal claim after alleged harassment

By Gráinne Nolan

Labour Court ·

The Labour Court dismissed a worker’s claim that alleged sexual harassment led to her constructive dismissal, finding it not well founded. The order was signed on 30 November 1988.

The worker said a more senior employee had harassed her and that the company had not responded adequately. The company denied the allegations and said it had investigated them. Most witnesses did not corroborate the alleged incidents. The Court found that the one incident supported by evidence did not amount to sexual harassment warranting a claim for constructive dismissal. It noted the company had taken no further measures after speaking with the worker, her mother and the person accused, but said that this could not form the basis of its decision.
