Labour Court backs Lucas Service Ireland’s flexibility agreement interpretation

By Niamh Kearney

Labour Court ·

The Labour Court recommended in favour of Lucas Service Ireland Limited’s interpretation of a flexibility agreement in a dispute with the Irish Transport and General Workers’ Union. The recommendation was signed on 29 November 1988. The dispute followed a worker’s return from maternity leave in May 1988, when she was assigned different duties from those she had performed before her absence. The union argued that the agreement allowed cover for absences, while the company said it allowed workers to move between jobs within the same grade. The Court considered the company’s interpretation, supported by its letter of 28 May 1985, correct.
