The Labour Court dismissed Ferrero Ireland Ltd’s appeal and set compensation for Patrick O’Callaghan at €15,000, varying the Adjudication Officer’s earlier €20,000 award. The determination was signed on 10 January 2025.
O’Callaghan challenged his compulsory retirement at 65, saying it amounted to age discrimination. The Court found Ferrero had not objectively justified mandatory retirement: its reasons, including health and safety, promotion opportunities and workforce planning, did not withstand scrutiny.
