The Labour Court has affirmed the dismissal of Siobhan McNally’s Employment Equality Act complaint against Rotunda Hospital as frivolous. Its determination was signed on 3 April 2025. McNally argued she remained on paid suspension and sought a substantive hearing. The Court said earlier unappealed findings that related claims were out of time could be considered in assessing whether this complaint had a realistic prospect of success.
