The Labour Court dismissed Ann Munoz’s appeal as out of time, leaving in place the WRC decision that it lacked jurisdiction over her discrimination complaint against Awp Health & Life Spa Allianz Partners. The Court’s determination was dated 8 August 2024. The merits were not decided. Munoz’s employment ended by redundancy on 30 November 2021, and she referred her complaint under the Employment Equality Act 1998 to the WRC on 12 October 2022, outside the six-month limit. The WRC found she had not established reasonable cause for the delay. Her appeal reached the Labour Court 43 days after the WRC decision, one day beyond the 42-day limit. The Court said it had no jurisdiction to extend the deadline.
