The Labour Court overturned a finding that Kerry County Council discriminated against Mary Mac Galey by failing to provide reasonable accommodation. The Court’s determination was dated 8 August 2024, and it set aside the WRC decision.
Mac Galey said she needed to work six half-days a week, with an extra half-day spread across her working days. The council said its work-sharing arrangements allowed four half-days and one full day, but could not accommodate that pattern. The Court noted there was no evidence that the request had been supported by a medical assessment after 2019. It found that the chief executive replied to Mac Galey’s December 2022 letter in January 2023 and that the letter did not establish a new discriminatory act within the relevant period. The Court concluded she had not established facts from which discrimination could be inferred.
