The Labour Court disallowed Kostas Avizinis’s appeal on his dismissal discrimination complaint and affirmed the Equality Tribunal’s decision, including its €500 award against J Ryan Haulage Limited. The award concerned discrimination in furnishing Avizinis with a safety statement in a language in which he was not competent. The determination was signed on 22 July 2010.

Avizinis alleged that his dismissal after a truck accident was race discrimination. The Court found he had not established facts from which discrimination in the dismissal could be inferred. It noted that an Irish-nationality driver had also been dismissed after a truck accident. Avizinis did not pursue his complaint about written particulars of employment; the respondent did not appeal the safety-statement finding.
