The Workplace Relations Commission rejected Kshitiz Agarwal’s unfair dismissal complaint after finding the redundancy was fair overall. It also rejected his complaint that a redundancy letter misstated his job title. Agarwal argued that consultation and appeal were flawed and no suitable alternative role was offered; the adjudication officer found that Jacobs Engineering Ireland Limited had consulted him, explored other roles and provided an appeal. The officer accepted that the company had ceased thermal energy operations and found the proposed €53,000 voluntary exit payment did not prove the redundancy was predetermined.
