The decision by adjudication officer Orla Jones was dated 2 October 2025. Whelan said his contract described him as working if and when required, despite a regular 39-hour week plus overtime. The company acknowledged the contract type was issued in error and said it had since provided a corrected contract. The adjudicator found the breach was ongoing and the claim was within time.
