The Workplace Relations Commission ordered Wayback (Clonmel) Burger Ltd to pay Berkay Gulmez €2,689 for failing to provide a contract of employment. The WRC also awarded him €1,344.50 for unpaid annual leave and €672.25 in gross wages for his final week. The decision was dated 6 August 2024. Gulmez said he had not received his final week's wages or pay for annual leave taken before his employment ended on 1 June 2024. The company representative said he did not know whether the final wages had been paid and that the company would pay if they had not. The company accepted it had not provided Gulmez with a copy of his contract. The adjudication officer found those three complaints well founded. The €2,689 award represented four weeks' remuneration, which the officer considered just and equitable given Gulmez's lack of awareness of his employment terms. A separate complaint about Sunday premiums was not well founded because payslips showed he had received an additional payment for Sunday work.
