The Workplace Relations Commission found that Ms Patricia Clarke was not entitled to pay for hours she chose not to work after her roster changed. Adjudication Officer Eileen Campbell issued the decision, dated 24 July 2024. Clarke said she had worked from 6am to 2pm but was moved to a 7am to 3pm roster. She did not want to work until 3pm and argued that her pay should still cover the full rostered hours. Dehac Retail Ltd T/A Costcutter Rathfarnham said the shop’s trading hours had changed and Clarke’s pay reflected her choice to work fewer hours. The adjudicator found that Clarke’s contractual hours remained available if she wished to work them. Because she chose to work five fewer hours a week, the pay for those hours was not properly payable under the Payment of Wages Act. Her complaint was not well founded.
