The Workplace Relations Commission found Daniel Oltean’s complaint against An Post not well founded. The decision, dated 13 August 2024, concerned his claim that the company unlawfully withheld sick pay. Oltean said he was absent from work from 7 to 12 February 2024 and was entitled to statutory sick pay. An Post said its own scheme was more favourable than the statutory scheme. The adjudication officer found that the policy allowed up to 183 paid sick days over four years, and that Oltean had received 192 days in the previous three-to-four-year period. The officer concluded the non-payment was not a deduction of wages under the Payment of Wages Act 1991.
