The Workplace Relations Commission upheld three complaints by Kumar Swapneel Shreyansh against 9Th Impact Limited, awarding €3,085.20 gross for unpaid wages and annual leave, €6,500 for unfair dismissal and €5,000 for race discrimination. The decision was dated 13 August 2024.
Shreyansh said he was owed December wages and payment for 12 days of unused annual leave. The respondent did not attend the hearing. The WRC found the wage complaint well founded and directed payment of €3,085.20 gross. It found the dismissal unfair because no procedures were followed and the respondent did not meet its burden of proof, awarding €6,500 compensation.
The WRC also found that Shreyansh had established a prima facie case that he was treated differently from Irish colleagues because of his Indian race. The respondent did not rebut the case, and the WRC found race discrimination and awarded €5,000. It upheld all three complaints.
