The company accepted that written terms and Sunday premium were missing, but said wages may have been paid in arrears. The adjudicator preferred Kelly's evidence on the wages and noted the respondent did not dispute that notice pay was unpaid. A separate road transport working-time complaint was withdrawn because it was filed in error.
