The Workplace Relations Commission found that David Marsa’s €2,500 deduction for two unreturned laptops was permitted under his employment contract. The WRC decision was dated 2 May 2024. Marsa, a former Head of Software Engineering at Physiolinked Ltd (Wellola), said the deduction exceeded the laptops’ value and that customs issues prevented him from returning them while outside Ireland. The company said its contract allowed deductions for unreturned property and that it had to replace the laptops. The adjudication officer found that replacement invoices showed the deduction did not exceed the employer’s cost. Marsa’s separate complaint about holiday pay was also not well founded; he did not dispute receiving his outstanding holiday entitlements.
