Truck driver qualifies for redundancy lump sum after lay-off

Frank Nelson qualified for a statutory redundancy lump sum after the Workplace Relations Commission found that his employer, Northway Personnel Limited, had not issued a timely counter-notice. His separate minimum-notice complaint was found not well founded. In a decision dated 2 May 2024, WRC Adjudication Officer Breiffni O'Neill said Nelson’s gross weekly wage was €854 for the redundancy calculation. The decision did not state the lump-sum amount. Nelson had worked as a truck driver since July 2016 and was temporarily laid off in June 2023 after a downturn in work at a site in Clonee, Co. Meath. He said the company did not respond when he asked about possible work in Greystones. The company said it offered him roles in Greystones, Kilkenny and Blessington and that he was required to travel to client sites.
