The WRC allowed Deirdre O Reilly’s redundancy appeal and directed Yankee Clipper Holding Ltd The Town Hotel to pay her a statutory redundancy lump sum. The decision was dated 7 March 2024. O Reilly said the company had agreed to pay her redundancy entitlement but had not done so despite repeated attempts to contact it. The company did not dispute that the payment was due, but said it was waiting for contract payments and could not give a date. It also confirmed that another redundant employee had received part payment. The adjudicator found the company had failed in its statutory duty after O Reilly’s 22 years of service and had prioritised another employee. The lump sum is to be calculated using her employment start date of 19 November 2001, notice date of 10 April 2023, termination date of 5 June 2023 and gross weekly pay of €351.45.
