The Labour Court rejected Dermot Flanagan’s appeal against a finding that his complaint about annual leave pay was not well founded. Its decision was dated 7 March 2024. Flanagan argued that leave he took in July and August 2023 should have been paid at his former bus driver rate, when the entitlement accrued. Dublin Bus said it should be paid at his normal weekly rate when the leave began. The Court found that the rules calculate holiday pay using the employee’s normal weekly hours last worked before leave starts. Flanagan had moved to a 30-hour First Bus Check Operative role, paid €583.05 a week. The Court concluded his leave pay was correctly calculated under those rules and affirmed the original decision.
