The Workplace Relations Commission ordered Joe And Barbara Hegarty t/a Heavens Cakes to pay baker Piotr Kaczmarczyk €200 compensation after finding that he had not been given written terms of employment. The decision, dated 11 April 2024, also awarded him €192 and €38 for unpaid wages and €62 for an annual leave shortfall. It upheld four complaints and found a separate safety penalisation complaint not well founded. Kaczmarczyk said he received no written contract and was underpaid, including for annual leave. The respondents said they had provided a contract and produced payslips. The WRC found they had not shown that the contract was provided during his employment. On the safety complaint, the officer said Kaczmarczyk had referred his concern about cake handling to the Food Safety Authority of Ireland rather than the Health and Safety Authority, and had left after a disagreement with the respondents.
