The Workplace Relations Commission found Vanessa Clarke’s statutory redundancy complaint against Bornodal Limited was not well-founded in a decision dated 18 July 2024. Clarke said she had worked since 2008 and that her employment had transferred between companies. She argued that new owners recorded a later start date and that former employers owed her redundancy payment. Bornodal said her employment transferred to another entity in November 2022, before the alleged redundancy. The adjudication officer found Bornodal was neither the transferor nor transferee in that later transfer, so the redundancy claim did not accrue against it. The complaint was not well-founded and the appeal failed.
