The Workplace Relations Commission found that Mhairi Gaine was not unfairly dismissed by the Health Service Executive, in a decision dated 18 July 2024. The registered nurse also lost two wage complaints and a working-time complaint.
Gaine said a meeting with her manager in August 2022, where staff complaints were raised without details, left her unable to continue working there. The HSE denied mistreatment and said the meeting was arranged to discuss concerns and give her a chance to respond. The adjudicator found the meeting's initial purpose reasonable, but noted that unspecified interpersonal complaints were raised.
Gaine raised concerns in writing but declined a grievance meeting and withdrew before a formal meeting took place. The adjudicator found she had not substantially engaged with internal procedures before resigning. The constructive dismissal complaint and the three other complaints were not well-founded.
