The Workplace Relations Commission found that Ha O'Neill Limited did not unlawfully withhold a bonus from Adrian O'Leary, whose complaint under the Payment of Wages Act 1991 was not well founded. Adjudication officer Catherine Byrne issued the decision dated 20 March 2025. O'Leary said he was owed a bonus for work in 2022 after resigning in February 2023. The company said the €40,000 bonus in an April 2022 letter related to 2021 performance and that bonuses were considered after annual accounts and reviews, with payment limited to current employees. The officer found that the €40,000 bonus referred to the performance-related arrangement and that O'Leary left before the review and payment period. She concluded it was not properly payable, so there was no unlawful deduction from wages. No award was recorded.
