The Workplace Relations Commission upheld Suellen Oliveira Farina Ferreira’s constructive dismissal complaint and awarded her €3,333 for losses attributable to her dismissal. It also awarded her €3,333, equivalent to four weeks’ pay, because her employer failed to issue an updated statement of employment terms.
The decision, dated 29 February 2024, found that changes to her role required an amended statement, which Mbc Products Ireland Ltd did not provide. Ferreira said her payslips and Revenue returns were inaccurate and that she repeatedly sought corrections. The officer accepted that she had exhausted internal avenues before resigning.
The officer found the evidence supported constructive dismissal, meaning the circumstances left Ferreira with no reasonable option but to resign. The company was in liquidation and did not attend the hearing or send a representative.
