The Workplace Relations Commission rejected Thomas Lane’s claim against Premier Recruitment t/a Morgan McKinley after finding he had no standing to bring it under the Protection of Employees (Fixed-Term Work) Act 2003. The decision was dated 7 March 2024. Lane said his one-year fixed-term contract was ended before its August 2023 end date and argued he should have been kept on or paid through to that date. The company said he was an agency worker outside the Act’s definition of a contract of employment and had received four weeks’ notice pay. The officer found that the other legislation Lane relied on did not change the Act’s definition, which excludes an agency arrangement of this kind. The complaint was found not well founded.
