The Workplace Relations Commission found that Sandra Houlihan was not discriminated against on grounds of age in a teacher recruitment process run by Limerick & Clare Education & Training Board. The decision, dated 7 March 2024, dismissed her complaint under the Employment Equality Acts.
Houlihan argued that her teaching experience exceeded that of the successful, younger candidate and questioned why she received lower interview scores. The ETB said candidates faced the same questions and conditions, and were assessed on qualifications, experience, communication and their capacity to contribute. Houlihan ranked sixth and was placed on a panel.
The adjudicator found Houlihan had established an initial case of age discrimination, requiring the ETB to explain its decision. Two panel members said the successful candidate gave more comprehensive answers and presented a stronger vision for the school. The adjudicator accepted their evidence and concluded that the ETB had rebutted the inference of discrimination.
