WRC rejects Giuseppe Torres’s nationality harassment claim against Kelby Developments

The Workplace Relations Commission rejected Giuseppe Torres’s employment equality claim against Kelby Developments, finding that he had not established facts capable of raising a presumption of discrimination. The decision was dated 7 March 2024. Torres alleged that Kelby employees verbally abused him because of his nationality. Kelby denied discrimination and harassment, and said it had received no complaint or report about the alleged incidents. The officer noted that Torres could not identify the worksite, dates, people involved or exact words, and had made no contemporaneous record. The WRC found that Kelby did not discriminate against or harass him.
