The Workplace Relations Commission (WRC), in a decision dated 14 March 2024, upheld three complaints by Andrejs Ratinskis against McCabe Entreprises(Cmx) Limited. It awarded him €3,011.72 for missing written employment terms and €1,500 each for excessive hours and breaches involving breaks and daily rest. The WRC also allowed Ratinskis’s redundancy appeal, finding that a proposed move from Belgard to Slane was unsuitable from his perspective because the journey was over an hour. It found he was entitled to a statutory redundancy lump sum, subject to insurable employment. His unfair dismissal complaint was withdrawn. Ratinskis said he received no written terms, worked excessive hours and missed breaks. The respondent disputed the complaints, saying employees received written terms, hours were not excessive and breaks were ensured. The WRC found that records supported the excessive-hours complaint and did not adequately establish that breaks and rest periods were provided.
