The Workplace Relations Commission found against Nevan Holland in his complaint that Doyle Shipping Group, Unlimited Company owed him four weeks’ pay in lieu of notice. Adjudication Officer Patsy Doyle issued the decision dated 19 April 2024. Holland, a Master Tug Captain, gave written notice by email on 24 March 2023 and expected four weeks’ pay under his contract. The company said he had agreed to leave at the end of March and was unavailable to work his notice. The officer found the email met the contract’s written-notice requirement and that four weeks’ notice pay was contractually due. But Holland was not ready and willing to work his notice period, so the claim failed under the Payment of Wages Act and related notice rules. The complaint was found not well founded.
