The Workplace Relations Commission awarded a financial adviser €460 for unfair dismissal, €800 for unpaid annual leave and €200 for a public holiday. Adjudication officer Kara Turner issued the decision, dated 19 April 2024. The WRC also found that Rr Financial Services breached minimum notice rules, but made no compensation award for that complaint.

Grazyna Roclawska-Zoladek worked for the firm as a commission-paid financial adviser. The firm said Central Bank rules required her to gain qualifications within four years and that it had to end her employment when she did not qualify. She said the exam requirements and consequences had not been clearly explained to her.

The adjudication officer found the firm had not shown that dismissal was its only reasonable option. Evidence about when the decision was made was inconsistent, and there was no formal communication explaining that her employment would end if she failed to qualify. The WRC also found the firm had not provided records showing it complied with annual leave rules, and there was no evidence that she received the public holiday entitlement.

Complaints about redundancy, minimum wage, Sunday work and other pay claims were not well founded; two further complaints were duplicates and also failed.
