The Workplace Relations Commission found Shauna Finnie was unfairly dismissed and awarded her €5,400. In a decision dated 19 April 2024, adjudication officer Roger McGrath also upheld her complaints about missed breaks, failure to notify her in writing of changes to her employment terms, and unpaid notice.
Finnie told the hearing that after taking sick leave in April 2023, she was left off the work roster and managers told her to look for another job. Black Vanilla Limited Barking Mad Pet Boutique did not attend the hearing. McGrath relied on Finnie’s uncontested evidence and found the dismissal unreasonable, with no procedures used before she was dismissed.
The WRC awarded €1,080 for missed breaks, €540 for failing to notify her of changes to her employment terms, and €540 in lieu of one week’s notice. The four complaints concerned her dismissal, statutory breaks, written notice of changes to her terms, and minimum notice.
