The Workplace Relations Commission ordered Northway Personnel Limited to pay Ghenadie Muravschi €160 after finding he received insufficient notice when his employment ended in December 2022. The decision, dated 27 May 2024, also found that three of his other complaints were not well founded and that one was withdrawn. Muravschi, who worked as a general operative at a site in Clonee, said he had not received his core employment terms, was unfairly dismissed and was owed annual leave pay. Northway denied the complaints and said it was an employment agency, not his employer for the unfair dismissal complaint. The WRC found that he received written terms on his first day and that Northway was not his employer for the purposes of the Unfair Dismissals Act. It also found the evidence did not establish his annual leave claim. The WRC found that Northway contravened minimum notice rules and directed it to pay €160, approximately one day’s pay. Muravschi withdrew his complaint under the Industrial Relations (Amendment) Act 2015.
