The Workplace Relations Commission awarded Danny Kearns €47.36 after finding one of his eight Payment of Wages complaints against Grant Engineering (Ireland) Unlimited Company well founded. In a decision dated 13 December 2023, it found the other seven complaints not well founded. Kearns, a welder who sometimes worked as a tester, said he stopped receiving an additional €5.92 daily rate for tester duties in September 2022. The company said the higher rate applied only to employees permanently assigned to the role. The officer found Kearns had direct, corroborated evidence that he had received the higher daily rate before and no evidence the company had told him it would stop. The officer found an implied contractual right to the additional rate and awarded €47.36, subject to normal income deductions. The remaining complaints were treated as captured in the lead complaint and found not well founded.
